When am I DBA proof?

It is nice for you and your client to be able to quickly provide certainty about whether the tax authorities regard you as a self-employed person for payroll tax purposes. Lack of clarity makes both of you insecure and you run the risk of missing out on an assignment if the client has doubts.

You actually want to convey in advance on your website and/or in your freelancer profile that your client is happy when he does business with you. You are 'DBA' proof! DBA is the abbreviation of the Deregulation Assessment of Labor Relations Act. On April 5, all owners of a VAR received a letter explaining the model agreement. The explanation seems almost too good to be true. However, it is true and it only provides certainty after the “Duck Test”.

If it is too good to be true, it might still be useful to take note of the content. For the truly self-employed person who has no doubts about his independence and where the client also behaves as a client and not as a semi-employer, the matter is settled, provided one behaves as described in the relevant model agreement. The risk of the convenience of providing a (correct) model agreement number by email and having it confirmed is that the content is not discussed and that is precisely the rub.
